De modo semelhante aos rompantes etnocêntricos de uma cultura humana frente a outras, as relações entre humanos e primatas não humanos incluem um estranhamento pontuado por atração e repulsa, identificação e diferença. Ciência, arte e mitologia são a expressão viva e atualizada disso. Desde 1960, a primatologia destaca-se nesse cenário por contribuir significativamente na revisão das definições sobre o comportamento dos primatas e, consequentemente, na redefinição do humano ao apresentar a polêmica proposição de existência de "culturas" entre animais não humanos. (...) Assim, a aproximação entre humanos e primatas não humanos parece inexorável e irreversível. Isso implica, por exemplo, em cogitar se esse processo engendra, ou não, a constituição de novas alteridades a partir de um novo outro (não humano), carregado de significados. Isso incluiria, por exemplo, a reformulação de representações e de categorias de classificação, bem como o aprofundamento do debate sobre os direitos dos animais não humanos. Ao dirigir tal tipo de desafio a situações de pesquisa antropológica deve-se ter aguda consciência de que o registro etnográfico das relações entre humanos e os outros primatas será uma construção empírica, perceptual e teórica. Dado o tipo particular de relação estabelecida entre humanos e outros primatas, pautada em um universo fronteiriço de incômodas semelhanças e diferenças, constituem-se aí coletivos híbridos em que o alcance e a profundidade das interações possíveis ainda são desconhecidos. The relations between humans and non-human primates resemble the ethnocentric reaction of one human culture in relation to others, and include an estrangement marked by attraction and rejection, identification and differentiation. Art, science and myths are the vivid and updated expression of these phenomena. Since the 1960's primatology stands out in that scenario for contributing significantly to the revision of the definitions about the behavior of primates and, consequently, for the redefinition of human beings, and for making the controversial proposal of the existence of non-human animal "cultures". Then, the close connection between humans and non-human primates seems relentless and irreversible - and raises the question on whether or not these processes engender a new kind of otherness deriving from a non-human other that is full of meaning. This would include, for example, the reformulation of the representations and categories of classification, as well as deepening the debate about the rights of non-human animals. When the challenge is taken up in situations of anthropological research that address the relationships between human beings and the other primates, the ethnographic register that describes the relations between human beings and other primates will be an equally sharp empirical, perceptual and theoretical construction. Given the peculiar type of relationship established between human beings and other primates, implemented in a frontier universe of uncomfortable similarities and differences, they constituted a hybrid collective where interactions are possible but we do not know exactly how complex or how depth they are. System analyses deal with interrelationships between different variables that keep the system in balance. In many analysis of complex thinking, a system is viewed as a complex unit in which the ‘whole’ is not reduced to the ‘sum’ of its parts; the system becomes an ambiguous item because it consists of several entities that interact with unforeseen results or, in other words, it is situated at a transdisciplinary level, it is impossible for an area to have a complete reading of (...) its complexity. It was also mentioned that the concept of the open system best describes complexity by stating that ‘the laws of the organization are not equilibrium, but an imbalance that is restored or compensated for by stabilized dynamics’. This idea originated from the field of thermodynamics and the second law, in which the imbalance that it maintains allows the system for an apparent balance. This fragile steady state has something of a paradox, since the structures remain the same, but their constituents are changeable. The concept of open system undoes the door to a theory of evolution that can only derive from the interactions between a system and its ecosystem. Within this systemic approach, the focus of the analysis takes into account the ambiguity, multidisciplinary and complexity associated with system adjustment, i.e. it is intended to qualify an employee job based on their experience and knowledge as a measure of their impact on the organization performance. Catholicism has been the hegemonic religion in Brazil. However, in recent decades the country is undergoing a major religious transformation, with a drop of Catholic affiliations and rapid growth of evangelicals, and a increase to a lesser pace, of other religions and no-religion. Hence, there is a growing religious plurality, although Christianity remains widely majority in the country. But within the Christian religion there is a change of hegemony between Catholics and evangelicals. An innovation of the dogma and the evangelical (...) practice occurred in the twentieth century, in the United States, allowed the spread of Pentecostal and neo-Pentecostal messages. Brazil, as the largest Catholic country in the world, is highlighted in this process. The state of Rio de Janeiro features as having the smaller proportion of Catholics and the most religiously diverse in the country. Its metropolitan area is the most advanced urban agglomeration in this changing process of hegemony. This paper shows, additionally, that the process of evangelical diffusion follows a spatial pattern that goes along the main roads of the Rio de Janeiro territory having as the focus of diffusion the periphery of the metropolitan area of ​​the State. This article proposes to analyse some aspects of the appropriation of New School thinking in Brazil, particularly Deweyan pragmatism, in the 1950s and 1960s. The analysis is based on the assumption that the developmentalist ideology that punctuated the debate on the economic, political and social restructuring of the country in these two decades constituted fertile ground for the return and expansion of pragmatist thinking amongst Brazilian educators, articulating itself, sometimes in contradictory ways, with this ideology. The focus of the analysis (...) will be on the writings of the group of educators which circulated around the figure of Anísio Teixeira, at the time director of the National Institute for Pedagogic Studies, an organ linked to the Ministry of Education and Culture, which set itself the task of producing research that would support public policy in the field of education, as well as constituting itself as a center for teacher education and the stimulus and development of innovative experiences in the public school system. The appropriation of Deweyan pragmatism, in this context, had a triple perspective: pragmatism as scientific method, implying a specific conception of science, particularly the social sciences, with emphasis on the application of scientific knowledge in the solution of practical problems; as a way of democratic life; and as a synonym for experimentalism, in the sphere of schooling. This paper focuses on the concept of the flâneur, deriving largely from the works of Baudelaire and Walter Benjamin, and attempts to reveal its contemporary relevance for sociological practice. The flâneur is treated as an instructive metaphor for the sociologist's relationship with modernity and urban life, and therefore as providing insight into the social, historical and theoretical contexts for the analysis of the world today. More than this, the idea of the flâneur is treated as highly instructive of research (...) strategies confronting urban life, namely ethnography. The paper seeks to expose a critical space between ‘realist’ and ‘textual’ ethnographies and provide a locus for the discussion of associated methodological problems. A burgeoning literature and tradition of work in this area is examined which will also be of interest to the sociological theorist. (shrink)

O objetivo do artigo é analisar a condução da política externa estadunidense com a China, entre 1890 e 1909, tomando como referencial a interpretação historiográfica dos autores revisionistas William Appleman Williams e Walter LaFeber. Propõe-se que o “anticolonialismo imperial” engendrado pelos Estados Unidos no processo de disputa pela abertura do mercado chinês está na origem dos conflitos com as tradicionais potências imperialistas. O trabalho explora, portanto, a tese historiográfica revisionista segundo a qual a política externa norte-americana radicada nos princípios (...) da “Open Door Policy” é fundamental para a compreensão de antagonismos que contribuíram para a Guerra Fria.The aim of the article is to analyze the conduct of US foreign policy with China between 1890 and 1909, taking as reference the historiographical interpretation of the revisionist authors William Appleman Williams and Walter LaFeber. It is proposed that the "imperial anticolonialism" engendered by the United States in the process of dispute over the opening of the Chinese market is at the origin of conflicts with the traditional imperialist powers. The paper thus explores the revisionist historiographical thesis that US foreign policy rooted in the principles of the Open Door Policy is fundamental to understanding the antagonisms that contributed to the Cold War. Resumen El objetivo del artículo es analizar la conducción de la política exterior estadounidense con China, entre 1890 y 1909, tomando como referencial la interpretación historiográfica de los autores revisionistas William Appleman Williams y Walter LaFeber. O objetivo do presente artigo consiste em apresentar uma reflexão sobre os paradigmas existentes e emergentes frente a um contexto teórico-científico e a necessidade de mudança devido aos desafios enfrentados em determinados momentos. Assim, o texto, de abordagem qualitativa e caracterizado como uma revisão bibliográfica, contextualiza acerca deste braço da filosofia que trata da natureza da pesquisa científica, do conhecimento no campo educacional, não somente do âmbito da epistemologia, mas também da fundamentação dos paradigmas das ciências e da educação, e (...) do conhecimento científico. As questões metodológicas estão diretamente relacionadas com essa reflexão sobre os resultados significativos e o que precisa ser modificado a partir de uma análise sobre o contexto social em que se está inserido. Para fundamentar este artigo, se apresentam as contextualizações que dialogam em torno de autores como Alda Judith Alves-Mazzotti, Pierre Bourdieu, Boaventura de Sousa Santos, Bernard Charlot, Edgar Morin, Thomas Kuhn e Mario Osório Marques. Portanto, o artigo expõe no seu panorama científico uma resposta às imposições das ciências na contemporaneidade, sem o rompimento com o passado e suas tradições, mas apresentando um olhar voltado para o futuro. A partir dessa perspectiva, precisamos ter clareza do campo científico em que estamos inseridos, conhecendo de fato suas peculiaridades para optarmos por um método que contemple as necessidades apresentadas, tendo segurança do que estamos fazendo. Enfim, pode-se concluir que os profissionais da educação precisam de uma base de pesquisa científica sólida para terem subsídios necessários ao experimentarem novas metodologias em suas práticas pedagógicas que sejam significativas para os estudantes. O presente trabalho aborda questões conceituais sobre o racismo no Brasil relacionadas ao processo histórico de colonização, destacando a criação de um imaginário coletivo hegemônico, eurocêntrico, patriarcal, reproduzido pela ideologia dominante e reforçado por práticas racistas nas relações sociais. Por outro lado, trazemos a decolonialidade como uma ruptura epistemológica que procura romper com as ideologias coloniais dominantes que imperam sobre o pensamento ocidental e aponta saídas para o enfrentamento do racismo estrutural. O aporte teórico se dá pelo olhar decolonial de (...) autores como Walter Mignolo (2017), Anibal Quijano (2009), Molefi Asante (2009), Nah Dove (2017) e Lélia Gonzales (1984) e das questões sobre raça, racismo, anti-racismo e racismo estrutural com autores como Kabengele Munanga (1999), Antônio Sérgio Alfredo Guimarães (1999), Carlos Moore (2007), Antônio Olímpio de Sant`Anna (2004). A metodologia utilizada foi a pesquisa bibliográfica de caráter exploratório e descritivo. A sociedade precisa acreditar que o racismo existe para ser combatido, ao contrário da forma velada e negacionista como se apresenta no cotidiano brasileiro. Como resultados, temos um imaginário popular para formas de racismo específicos sedimentados culturalmente por um projeto de colonização que impôs e impõe a imagem do negro com características de inferioridade nas mais diversas instituições sociais existentes: racismo estrutural, racismo institucional, racismo midiático, racismo epistêmico e racismo ambiental. In our contribution we will observe phenomenal architecture of a mind and operational architectonics of the brain and will show their intimate connectedness within a single integrated metastable continuum. The notion of operation of different complexity is the fundamental and central one in bridging the gap between brain and mind: it is precisely by means of this notion that it is possible to identify what at the same time belongs to the phenomenal conscious level and to the neurophysiological level of (...) brain activity organization, and what mediates between them. Implications for linguistic semantics, self-organized distributed computing algorithms, artificial machine consciousness, and diagnosis of dynamic brain diseases will be discussed briefly. (shrink)

Albert Camus defended his romance La Peste against the accusation of Roland Barthes that is was “dehors de l’histoire”, pointing out that it (...) was not only about the recent historical phenomenon of Fascism, but also about the permanent risk of its rebirth. Agnes Heller associates faith with prejudice and alienation. The following article will explore the Thomist concept of truth, Benjamin’s concept of history, Camus’ allegory of the plague, Agnes Heller’s notion of faith and Castro Alves’ powerful denouncement of slave traffic, to better criticize the phenomenon of post-truth, a rebirth of fascist information practices. The theme of consent is, without question, associated with the origins of bioethics and is one of its most significant paradigms that has remained controversial to the present, as is confirmed by the proposal for its debate during the last World Congress of Bioethics. Seen broadly as a compulsory minimum procedure in the field of biomedical ethics, even today it keeps open the issues that it has raised from the start: whether it is really necessary and whether it can be (...) proven to be effective. My goal will be to attempt to determine the most genuine and relevant meaning of consent, going back from its present dominant normative meaning and, from there, identifying or simply sketching other possible forms of its expression in the world we live in, so as to justify its pertinence and validity. This objective will involve three stages: (1) ‘Consent’ as a privileged paradigm of bioethics (the ethical-juridical sense), (2) The symbolic value of ‘consent’ (the social-cultural sense), and (3) ‘Consent’ as promotion of the human (the humanistic-personal sense) .It is concluded that the common notion of normative consent is not the only one, nor does it hold universal validity; that, from a historical-cultural perspective, new expressions of consent appear, adapted to different social contexts and to possibly be implemented in developing countries; and, finally, that consent is strictly indispensable in situations of extreme dependence, in its symbolic relational character, in as much as it promotes ethical relationships among strangers and ensures that they remain so. Are demands for equality motivated by envy? Nietzsche, Freud, Hayek, and Nozick all thought so. Call this the Envy Objection. For egalitarians, the Envy Objection is meant to sting. Many egalitarians have tried to evade the Envy Objection.. But should egalitarians be worried about envy? In this paper, I argue that egalitarians should stop worrying and learn to love envy. I argue that the persistent unwillingness to embrace the Envy Objection is rooted in a common misunderstanding of the nature of (...) the charge, what it reveals, and what can be said in response to it. I develop what Bernard Williams might call a vindicatory genealogy of envy, thereby allowing us to see that envy, rather than undermining egalitarian intuitions, can in fact play a distinct justificatory role (when it is fitting), which undermines the Envy Objection. The text analyses rituals as endeavours to preserve the identity of a people or a portion of a people. Rituals present or re-present the supposed common history of all the migrants. Social memory and history then tend to merge and to forget... forgetfulness is the driving force behind the writing of history. Particularly critical is the moment when the migration starts, because the need to adapt to new conditions as well as to maintain what is represented as their social identity (...) makes dual – and at times contradictory – demands on the migrants’ imagination. Examples taken from Portuguese migrations are offered as expressions of the conceptual issues raised. (shrink)

Dorothy Edgington’s work has been at the centre of a range of ongoing debates in philosophical logic, philosophy of mind and language, metaphysics, and epistemology. This work has focused, although by no means exclusively, on the overlapping areas of conditionals, probability, and paradox. In what follows, I briefly sketch some themes from these three areas relevant to Dorothy’s work, highlighting how some of Dorothy’s work and some of the contributions of this volume fit in to these debates.

This article analyzes the issue of organizational transparency through the lens of Thomas Aquinas’ ethics. It provides moral justification for current claims about corporate transparency and sheds light on the ethical values and virtues affecting information disclosure decisions. Transparency is conceptualized as an informational mechanism necessary for performing the virtues of truthfulness, justice, and prudence. This article extends the organizational transparency and corporate social responsibility literatures by providing an alternative moral justification grounded in virtue-based theory, which extends our understanding of (...) the information disclosure decisions made by management. El profesor Robert Walter, el más eminente representante de la Teoría Pura del Derecho en nuestro tiempo, estudia en "Hans Kelsen, la Teoría Pura del Derecho y el problema de la justicia" y "Normas y enunciados sobre normas", los dos textos que componen esta obra, los puntos centrales del pensamiento filosófico y jurídico de Hans Kelsen.

Se resume en esta obra el vasto y complejo sistema teórico-jurídico de Hans Kelsen, el jurista más grande de nuestro siglo. La doctrina de Kelsen y en particular su Teoría Pura del Derecho han conocido muchas vicisitudes y ataques debidos más a prejuicios políticos y racistas que a una verdadera confrontación con sus tesis. El autor enfatiza en el hecho de que la doctrina jurídica de Kelsen no es una teoría terminada y archivada sino en permanente desarrollo, una teoría a (...) cuya ulterior construcción están convocados todos los juristas. Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

The susceptibility of Habermas' socio-political theory (and notion of constitutional patriotism) to the charge of motivational impotence can be traced to a problem in the way in which he conceives of discursive practical reason. By implicitly constructing the notion of discursive rationality in contrast to, and in abstraction from, the rhetorical and affective components of language use, Habermas' notion of discursive practical reason ends up reiterating the same binaries — between reason and passion, abstract and concrete, universal and particular — (...) that provide the tacit parameters used by his critics to motivate the charge of impotence. Habermas' project of reconciling social integration and political rule with freedom can succeed only by rebuilding his discourse-ethical theory of politics upon a notion of discursive practical reason that overcomes these philosophy/rhetoric binaries common to both camps. Muitas vezes os juristas consideram científico o seu saber e o seu fazer sobre normas jurídicas – a chamada dogmática jurídica. Isso é feito sem maiores problematizações, como se o caráter científico fosse um dado, uma obviedade, um truísmo. O conceito de ciência, por sua vez, é o objeto principal de uma disciplina do saber filosófico: a Filosofia da Ciência. No presente artigo, pretendo compreender o que é a Filosofia da Ciência, qual o seu campo de atuação, para então refletir (...) sobre se e como ela se aplica à dogmática jurídica. Para isso, realizei pesquisa teórica e bibliográfica cujo ponto de partida residiu no recorte bibliográfico feito pelo curso “Philosophy of Science”, da plataforma Saylor Academy. Foram examinadas, sistematizadas e confrontadas diferentes fontes com o intuito de identificar a posição mais consistente. Dentre os principais resultados, encontram-se: a identificação da Filosofia da Ciência como disciplina distinta das disciplinas empíricas ou observacionais sobre Ciência; a confrontação dessa disciplina com a crítica que denuncia sua suposta inutilidade; a defesa da relevância da Filosofia da Ciência e de sua aplicação ao Direito. The article deals with „The Symbolic Force of Human Rights“. Firstly, it restricts the meaning of the term „symbolic“ and of the expression „symbolic force“. Secondly, it discusses two matters: (1) a semantic matter, concerning the meaning of human rights; and (2) a pragmatic matter, related to utterance of human rights’ holders. The article emphasizes that it is not about „eternal“ rights, but rather a legal-political construction and conquest of modernity. Based on such assumptions, the author goes to the core (...) of his argument, characterizing the symbolic force of human rights as ambivalent: on one hand, it serves for the generalized affirmation and accomplishment of rights related to legal inclusion in conditions of structural dissension; on the other hand, it acts as a manner of political manipulation, whether to conceal circumstances involving lack of rights or, more abruptly, to give cause to political oppression. In this regard, the article focuses, firstly, on the symbolic force of human rights at the level of National States, and then within the international and worldwide context. Finally, the author states a brief critique concerning the rhetorical use of human rights by the nowadays’ unique superpower, the United States of America. (shrink)

This article sets out to move from questioning the autonomy of law from the external standpoint of sociology to problematizing it from the internal legal standpoint. The first step is an analysis of the Kelsenian theoretical model of the hierarchically structured self-production of law, taking into consideration the concept of reason for the validity of a norm and of a legal order, as well as the role of efficacy as a condition for validity. The second is a presentation of Luhmann’s (...) conception of autopoiesis of the legal system, and in particular the function of the Constitution in the operative closure of law. Based on this exposition, the discussion then focuses on the limits of both conceptions, but in reverse order: first questioning the possibility of transporting the concept of autopoiesis to the different conditions for reproduction of law in contemporary world society, and then raising objections to the adequacy of the concept of hierarchically structured self-production of law to the many different legal orders in today’s world. The conclusion drawn from these critical observations is the argument that the Luhmannian sociological theory of the operative self-reference of the legal system and the Kelsenian legal theory of the self-produced step-structure of law are applicable only to legal systems minimally grounded in the rule of law. This paper stems from the current global worsening of the scarcity of resources for healthcare, which will deepen even more in future public emergencies. This justifies strengthening the reflection on the allocation of resources which, in addition to considering technical issues, should also involve ethical concerns. The two plans in which the allocation of resources develops—macro and micro—are then systematized, both requiring the identification of ethical criteria for the respective complex decision-making. Then, we describe how the complexity at the macro (...) level focuses on the joint consideration of the rectitude of the principles, the goodness of the ends, and the integrity—respectively the deontological, teleological, and procedural perspectives; and at the micro level, it focuses in prioritizing people, which can result in the exclusion of some, as happened with the elderly during peaks of COVID-19. The main objective of this article is to show that, in public health emergency situations, in which the daily criteria for prioritizing access to health care are not efficient, it is possible not only to ration the available means but also to rationalize them. We argue that rationing and rationalization are different concepts, entail different consequences, have different ethical foundations, and draw different guidelines for patient care. We apply them to the distribution of intensive care and vaccines to the elderly thus demonstrating the ethically legitimate domain of implementation of each of these two prioritization criteria. We conclude that rationalization respects more strictly the core ethical principles of our common morality. (shrink)

The notion of “integrity” is currently quite common and broadly recognized as complex, mostly due to its recurring and diverse application in various distinct domains such as the physical, psychic or moral, the personal or professional, that of the human being or of the totality of beings. Nevertheless, its adjectivation imprints a specific meaning, as happens in the case of “scientific integrity”. This concept has been defined mostly by via negativa, by pointing out what goes against integrity, that is, through (...) the identification of its infringements, which has also not facilitated the elaboration of an overarching and consensual code of scientific integrity. In this context, it is deemed necessary to clarify the notion of “integrity”, first etymologically, recovering the original meaning of the term, and then in a specifically conceptual way, through the identification of the various meanings with which the term can be legitimately used, particularly in the domain of scientific research and innovation. These two steps are fundamental and indispensable for a forthcoming attempt at systematizing the requirements of “scientific integrity”. (shrink)
